In Green v Green, NYLJ, 7-6-93, P.33, Col. 2, Sup. Ct., Kings Co. (Rigler,
J.) Justice Rigler, held that New York Domestic Relations Law
' 75-e requires "reasonable
notice and an opportunity to be heard", to confer jurisdiction in a
Hague proceeding. As the mother had commenced an action against the
defendants in the New York Supreme Court, to enjoin them from removing
the children to Israel and the father served her attorney with a
cross-motion to include a Hague Convention petition with that action,
this was sufficient to confer jurisdiction.
